1. Acceptance
These Terms of Use govern the Oscarpes app ("App"), mobile and web (app.oscarpes.com.br), owned by OSCARPES E.A.S. (Empresa por Acciones Simplificada), RUC 80176938-8, Zanja Pytã, Department of Amambay, Paraguay ("Oscarpes", "we"), a company of the Oscarpes Group. By creating an account, signing in or using the App you accept these Terms and the Privacy Policy.
2. What the App does
A field tool for agronomic work: grower, farm and field records with GPS boundaries; automatic sampling grids and GPS navigation to each point; sample barcode scanning; offline work with later sync; fertility reports and maps; field notebook (applications, pests, weeds, diary, rainfall, photo timeline); satellite imagery, NDVI and weather; exports in PDF, KML, GeoJSON, CSV and Excel. Business modules (inventory, grain storage, invoices, finance) are restricted to authorized staff.
3. Account
You must be at least 18 and provide true and current information. You are responsible for your credentials and for everything done with them.
4. Plans
Use is free up to 500 hectares sampled per calendar month. Above that, extended plans are arranged directly with our sales team, outside the App. The App sells nothing inside it, has no automatic billing and collects no card data. Clients of the Oscarpes laboratory may receive extended use under a separate agreement.
5. Your data
The data you enter — records, fields, boundaries, samples, photos, reports, notes — remains yours. You grant us a non-exclusive, free, revocable license to store, process and sync it, generate the reports and exports you request, and use anonymized, aggregated data to improve the App. If you register data of other people (growers, staff), you confirm you have a legal basis to do so.
6. Acceptable use
Do not use the App for illegal or fraudulent purposes, try to access other organizations' data, reverse-engineer the App, overload the infrastructure, resell access without written permission, or enter false data. Violations may lead to suspension.
7. Availability and liability
We work to keep the App available but do not guarantee uninterrupted operation; third-party services (maps, satellite, weather, hosting) may fail. GPS positions and calculated areas have a margin of error. Agronomic, commercial and financial decisions based on the App are your sole responsibility. Our total liability is limited to the amount you paid in the 12 months before the event, without prejudice to mandatory consumer rights.
8. Intellectual property
The App, the Oscarpes brand, logos, design, source code and documentation belong to OSCARPES E.A.S. and the Oscarpes Group companies. Using the App transfers none of these rights.
9. Account deletion and termination
You can delete your account at any time in the App: Profile → Delete my account. It is disabled immediately and your personal data is deleted within 30 days; signing in again within that period cancels the request. If you cannot sign in, see oscarpes.com.br/excluir-conta. We may terminate accounts for breach of these Terms, fraud or security risk, with prior notice whenever possible.
10. App stores
When you download the App from the App Store or Google Play, these Terms are between you and OSCARPES E.A.S. only — not Apple or Google, which are not responsible for the App, its maintenance, support or any claims about it. The store's own terms also apply. Apple and its subsidiaries are third-party beneficiaries of these Terms with respect to use of the App on Apple devices.
11. Changes, law and contact
